Terms and Conditions

Services provided by Khmer Engineering Job through the Site shall be available to Applicants or other users (Advertisers). Access to and use the contents and services provided on the Site shall be subjected to the terms and conditions so-called " Terms and Conditions" and Privacy Statement. By continuing use of the site, please make sure that you have read and understood the Privacy Statement and the Terms and Conditions that you agree to be bound by all its provisions. 

1. Definition 

The following terms have the meanings as specified below

-      "Advertiser(s)": Refer to user who places an advertisement on the Site

-       "Applicant(s)": Refer to user who seeks services or employment opportunities offered by Advertisers on the site

-       "Khmer Engineering Job": Refer to Trading name of providing services

-        "Site": Refer to Website or Mobile Apps owned and operated by Khmer Engineering Job

       The terms "you", "user", and "users" refer to all individuals and/or entities accessing and /or using the Site at any time for any reason or purpose. 

2. Acceptable Site Uses

a. For Applicant

        i. Applicant agrees that he/she shall use the Site for lawful purposes and seeking employment and services opportunities. 

         ii. Applicant confirms and acknowledges that he/she discloses his/her personal data and all other information to the Advertisers and/or Khmer Engineering Job by his/her own willing when he/she applies for available employment and services opportunities posted on the Site, and/or when Applicants uses the Site for submitting, uploading, or posting information and data on the Site in response to advertisements. Applicant permits Khmer Engineering Job to store his/her information or data in the database of Khmer Engineering Job when submitting, uploading or posting information and data on the site. On the other hand, Applicant may send his/her information or data to Khmer Engineering Job through the Site in reply to any advertisement. In this condition, Applicant’s information or data will remain active on the Site and be stored in the Databased is at his/her own risk unless and until he/she deletes them. 

Applicant acknowledges and agrees that Advertisers who use Khmer Engineering Job's services to evaluate the appropriateness of Applicants for services or employment possibilities may access his or her information or data. If it is deemed that the submitted information is erroneous, false, illegal, unlawful, or infringes on any intellectual property rights or invades the privacy of any other person, Khmer Engineering Job has the right to reject the Applicant's information.

        iii. Khmer Engineering Job will not disclose an Applicant’s personal data to any Advertiser without his/her permission unless required by applicable laws and regulations. If he/she permits it, Applicant understands and agrees that Khmer Engineering job will release his/her information or data to Advertiser to recruit and analyze the suitability of Applicants for service and employment opportunities.

        iv. Even though, Khmer Engineering Job try to restrict access to the Database only to the Advertisers and personal of Khmer Engineering Job, it is not fully guaranteed 100% that other parties will not gain access to the Database without consent from Khmer Engineering Job. Applicant acknowledges that the Advertisers and other parties who have gained access to the Database may have retained a copy of Applicant’s information or data. Khmer Engineering Job is not responsible for the retention, use or privacy of information or data in these situations, or for the use or privacy of information or data by any of such parties while information and data are in the Database. Applicants are fully accepted his/her own risk when all personal data or information is provided to advertisers or other users or uploaded on or through the site.

b. For Advertiser

        i. Advertiser agrees to use the Site solely for lawful purposes such as recruitment, promoting, and marketing activities. 

        ii. Currently there is no fee charged for advertisers, however, this will be charged in the future. Khmer Engineering Job reserves the right for this change. 

        iii. Advertiser shall be solely responsible for the contents and materials contained in its advertisement and/or web page posted on the Site. Khmer Engineering Job reserves the rights to remove or edit or requires the removal or change any advertisement if it is inappropriate, as well as to require the removal or suspension the Advertiser’s access and use of the Site and/or service offered on or through the Site. 

c. For Users

        i. User shall not submit incomplete, false, or inaccurate information or data on the site

        ii. Any communications or use of the Site for any purposes other than recruitment, marketing purposes, including but not limited to political campaigning, or soliciting of donations or business for any reason, is strictly forbidden.

        iii. User agrees not to use the Site in any way that infringes on another's intellectual property or property rights.

        iv. All users are prohibited from violating or attempting to violate the security of the Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or libelous advertisements for products or services.

        v. Users are not permitted to upload, post, publish, transmit, distribute, circulate, or store any materials in whatsoever way related to the Site: 

        - in violation of any applicable laws or regulations 

        - in any manner that may infringe the copyright, trademark, or other intellectual property rights or proprietary rights of others

        - that is harmful, defamatory, libelous, obscene, discriminatory, harassing, threatening, abusive, hateful, racist, blasphemous, false, illegal, improper, or is otherwise offensive or objectionable

        - in the manner that causes unrest in politics, religion, national security, or stability of Cambodia

- that contains viruses, worms, corrupted files, or other materials that may interrupt, damage, or limit the functionality and operation of the Site, the services, or any computer software, hardware, telecommunication equipment.

        vi. All users are prohibited in using screen scraping, data mining, robot or similar data gathering and extraction tools on the Site for the purpose of establishing, maintaining, advancing, or reproducing information contained on our Site to your own website or in any other publication, except with our prior written consent. 

 3) Intellectual Property Rights

All information, text, images, layout, designs, pictures, HTML, and other proprietary materials on the Site are the intellectual property of Khmer Engineering Job or its licensors and are protected under copyright, trademark, patent, and other intellectual property laws. Except as otherwise provided in this paragraph, users shall not procure, assist or facilitate any third party to, copy, reproduce, transmit, publish, disseminate, distribute, redistribute, broadcast, circulate, store (in any medium), display, modify, sell or transfer or participate in the sale or transfer of or offer for sale of, create derivative works from, or in any way exploit any of the Contents, whether in whole or in part. Users may download or copy the Contents only for their personal non-commercial use and/or users that are specifically permitted in these Terms and Conditions. 

4) Responsibility

        Khmer Engineering Job reserves the right to monitor the Site and its contents at any time even though it is not necessary to do so. Khmer Engineering Job takes no responsibility whatsoever for any material on the Site that is not posted by Khmer Engineering Job or is posted by Khmer Engineering Job instead of a user. All users acknowledge and agree that they are solely responsible for the form, content, and accuracy of any information, data, advertisement, web page, and/or material submitted by them to Khmer Engineering Job or that posted by them on or through the Site. Khmer Engineering Job shall not in any way be considered as an agent of either Advertiser or Applicant with respect to any use of the Site. 

        Khmer Engineering Job does not warrant that the Site will function without errors, that the Site and its server are free of viruses or other harmful mechanics, that any problems will be solved, that the site’s operation will be uninterrupted or timely, or that the shortage of data will be secured. Khmer Engineering Job disclaims all warranties about the accuracy, reliability, completeness, timeless or other qualities of the Site and the contents, services, software, text, graphics, and links contained within to the fullest extent permissible. 

 5) Users Risk

        All Users use the Site and any other websites linked to it, completely at their own risk. Khmer Engineering Job does not represent or guarantee the truthfulness, accuracy, or reliability of any of the communication posted by users or endorse any opinions expressed by users. Khmer Engineering Job reserves the rights to remove any users and prevent their further access to the Site at any time for breaching the Terms and Conditions or violating laws and regulations and reserves the rights to removes any materials which are abusive, illegal, disruptive, or inappropriate at Khmer Engineering Job without giving any notices. 

 6) Link to Other Websites

        The Site may contain links to third-party websites. Hence, Khmer Engineering Job has no rights to control and is not responsible for the availability or security of such third-party websites. If users access any link to third-party websites, they are completely at their own risk. 

7) Disclaimer

        To the fullest extent permitted by applicable law, Khmer Engineering Job shall not be liable in any event for damage of any kind suffered by any users, whether directly or indirectly arising from or relating to their use of or inability to use the Site and its contents.

8) Termination

        Khmer Engineering Job reserves the rights at any time to immediately terminate or suspend any user’s account or access the Site without notice if the user has breached any of the Terms and Conditions or violate any law or regulation, and to take further action that Khmer Engineering Job deems appropriate, including removing any material which it deems abusive, illegal, disruptive, or inappropriate.

9) Modification to Access or Site

        Khmer Engineering Job reserves the rights at any time to modify, change, suspend, discontinue, or restrict: 

i) Users’ access to, either temporarily or permanently with/without notice

ii) Any portion or whole of the Site with/without notice

10) Governing Law and Jurisdiction

        The Terms and Conditions and any dispute or matter arising from or incidental to the use of the Site shall be governed by and constructed in accordance with Cambodian law.

11) Variation of Terms

        - Khmer Engineering Job reserves the right to change these Terms at any time. If doing so, Khmer Engineering Job will provide notice by publishing the varied Terms on the Site.
